Systematic Action for Refund by aggrieved Unit Holders against the Spaze Tower Case

Based on the facts and circumstances, we strongly believe that the unit holders of Spaze Tower Gurgaon have all been cheated. 

Under various provisions of law, the Directors of Spaze Towers Private Limited are personally liable to refund our money.

In this regard, you may also note that several people (unit holders) who had instituted litigations and had FIR’s registered again Spaze Towers, have subsequently been settled in-person.  

It is clear that the only way to get a refund is by following the provisions of law through collective action.  You may also note that there are several cases pending on behalf of unit holders for Spaze Boulevard, Spaze Arrow, Spaze Corporate Park, Spaze Privy etc.  

When the Insolvency Resolution Professional had been appointed, and insolvency process started against Spaze Towers, they settled the original petitioner.  However, the fact that there were over 450 others unit holders was never disclosed to the Supreme Court of India, when the insolvency process was withdrawn.

There is a complaint by Unit holders of Spaze Arrow pending in NCLT Delhi, a complaint by unit holders of Spaze Corporate Park in NCLT Chandigarh, a complaint by the landowner of Spaze Arrow in NCLT and a complaint by the landowner of Spaze Boulevard in NCLT Chandigarh.

 Spaze Towers has also changed their registered address from Delhi to Gurugram – a writ petition against this matter is pending in the Delhi High Court. There are other writ petitions, litigations,  FIR’s pending in Delhi and Gurugram.

On a related note, it has been brought to our attention that the Directors of Spaze Towers are travelling in luxury cars of over Rs. 120 crores, buying lavish farmhouses and hosting lavish weddings in Dubai and Singapore.  In our opinion, given the facts and circumstances, the Directors of Spaze Towers have systematically cheated people of India to enrich themselves and to fund their lifestyle, while these innocent people have lost their life savings.
